Hi everyone! Well some of you remember me asking about selling the rights to my "Shoot for the Stars" deviation, well I'm glad I raised the price (by 8 times the amount in fact) since the person glady paid me $400 for it!!!
in fact, he took that price no questions asked, no attempt at haggling me...I guess that has me a little concerned as it makes me question whether this thing of his really is just a small thing he's setting up (I will kill myself if this game of his becomes the next World of Warcraft) But oh well, it's a risk all artists take when selling their work...it's not much different to a traditional artist selling their painting or drawing, and I don't think I would ever get an offer like that on that particular work again, so I got more money out of this than I will ever get in print sales on DA anyway
In appreciation for all your thoughts (which actually got me on todays most popular journals at the time) I decided to feature a deviation from everyone who commented by surprise...I can't say I agreed with all comments, but I respect and understand everyone's views nonetheless, and will keep that journal, and all its comments for future reference too

Other news This dreadful house-move is STILL going, I managed to get most of my plants and fish across safely…but I would be lying if I said there were no fatalities

Because of this move, I have no internet connection, and probably won’t over the next week. I’ve been keeping on top of my DA messages in class, but things like the deviations that appear on my watchlist will have to wait, Because of this, I might be a bit slow when it comes to responding to messages, as I only have class 3 times a week, and I’m NOT using the public ones, since they charge a ridiculous $2 for a crappy 20 minutes…DA would send me broke at that rate, still, I have my laptop, just no internet, so I can still make art

I was sloppy in my sales agreements in the early years, and now I cannot even show the work on DA without the buyers permission. Many of them I can't even track down years later, and two have said no.
So, it is very important to use the proper sales agreements, to protect your rights. There are standardized sales agreement forms you can get.
Even selling a work basically royalty free, should still retain some controls on the use of your work, like to forbid its use to racially defame others, etc., and to retain the right to show your art to the general public, or have it published in an art book, or on a web page commemorating your work.

Something to consider in the future, for art to be used in an ad campaign, for book covers, web pages, games, movies, etc, is to manage the rights.
Managing your copyright rights is complex enough to warrant an artists time to look into it and understand it.
For example, the art you sold could have been set up with a royalty agreement that only kicks in if a certain number of units is sold, or a certain gross proceeds are earned, and then you get a small royalty for each game sold. Volume adds up.
An agreement like this is preferred by some buyers because if their venture does not pan out, it won't cost them anything more. When their business is fighting to become viable, they don't have to worry about the extra expense of paying royalties. Then, once they are profitable, they are in a better position to pay royalties.
Some agreements change if your work is going to be used in commerce (to sell something).
Many artists negotiate on a case by case basis, and some use standardized contracts based on end use of your work, quantity, etc.
I hope some of this is of some use.
Hmm, well as you can imagine, like all young people, I did kinda rush into it, the money was tempting, though I got the opinions of family and friends first, and many of my watchers here, and after some discussion, I averaged everyone's opinions out as best as I could and I figured it was a wirthwhile amount of money
I'm about to sell another work now actually, and as you can imagine, I'm taking the legal rights and so-on much more seriously
